Landlord-Law Kits - Kit 3 - Accelerated Possession Proceedings.
"Just to let you know we used your kit for the accelerated possession and it all worked out fine and we now have our property back.......THANK YOU." - Sally Keaveney, Landlord
The aim of our online kits is to help individuals to bring simple claims themselves to the county court, without the need for instructing a solicitor. This kit is for bringing proceedings for possession against tenants using the ‘accelerated’ possession procedure. This can be used in the following circumstances:
- where the tenancy is an assured shorthold tenancy, and
- the landlord has served a correctly drafted two month section 21 possession notice
Provided the criteria are made out and the paperwork is correct, a possession order will be granted without the need for a hearing.
The accelerated possession procedure at first sight appears easy. However many landlords have discovered to their cost that Judges are unforgiving if there is a mistake in the paperwork, and have had their claims dismissed and had to start again, often losing many months before they finally recover their property (which can be expensive if the tenant is not paying rent). This kit gives landlords the legal background to know whether their claim is well founded, and help and guidance with the forms so their claim will not be dismissed on the basis of incorrect paperwork.

Instructions. This is the most important part of the kit. The instructions:
- Explain the circumstances when you can use the special ‘accelerated’ procedure
- Provide detailed instructions on completion and service of the proper notices for possession
- Give detailed instructions on completing the court forms
- Explain how to apply for possession
- Give guidance on what you should do if there is any challenge or if the tenant asks for extra time
- Explain how to enforce the possession order through the court bailiffs
The instructions are written on the basis that the reader knows nothing about court proceedings, and are very detailed.
Possession notices. These need to be served before proceedings for possession can commence. There are also special guidance notes and covering letters
Information on the TDPS. Claims for possession under s21 will normally fail if your deposit is not protected under one of the government authorised tenancy deposit protection schemes.
Court claim form. This is partially pre-drafted for you. We also include a blank court form just in case the kit form is not suitable for you
Other forms. There is also a certificate of service form and the form you need to instruct the bailiffs.
Articles. There are also some relevant articles from the Landlord-Law site, to help you.
All kits include telephone support and access to an online discussion forum.
The kit can be purchased from the
Online
Kits section of the online shop.
