BRINGING PROCEEDINGS FOR POSSESSION OUR SERVICE
There are three stages in bringing proceedings for possession:
Stage one - the notice
Stage two - court action
Stage three - enforcement
STAGE ONE - THE NOTICE
The proper form of notice must be served on your tenant first. Often this will be sufficient, and court action will not be necessary. However if you do need to bring court action, this will not normally succeed unless the proper form of notice has been served first.
Note - we prefer all notices to be served by hand upon the tenant, either personally or by posting it through the letter box of the property.
Landlord-Law Members have three options:
1. You can draft the notice and serve it yourself using the onsite forms and information. Annual members only - NO CHARGE
2. You can instruct us to draft the notice for you, for service either by yourself of by someone else on your behalf. Annual members only - OUR CHARGE £75.00 (£63.83 plus VAT). NB VAT is charged at 17.5%.
3. You can instruct us to draft the notice and pass it to process servers to serve. This is useful for landlords who cannot or do not wish to serve the notices themselves and who do not have someone local who can serve the notice for them. Annual members only - OUR CHARGE £175.00 (£148.94 plus VAT)
Our advice service
There is extensive information on the site for members on the various types of proceedings for possession and the appropriate notices to serve. However if you are uncertain what to do, we will (if you are an annual member) consider your case and paperwork, and advise, for a fixed fee of £95.00 (£80.85 plus VAT)
STAGE TWO - COURT ACTION
There are two main types of court action for which we offer a fixed fee:
1. Accelerated possession proceedings (special proceedings where there is no hearing - only available for assured shorthold tenancies after a section 21 notice has been served) - Annual members only - OUR CHARGE £385.00 (£200 plus VAT and the court fee)
If you would prefer not to instruct us to act for you, you can also purchase our online kit (kit 3) which has all the information necessary for you to bring a claim yourself - Annual members £50, otherwise £92.00 including VAT
2. Possession proceedings based on serious rent arrears (ie over 2 months worth) - Annual members only - OUR CHARGE £596.00 (£380 plus VAT and the court fee. Includes representation at the hearing)
Again, if you would prefer not to instruct us to act for you, you can also purchase our online kit (kit 5) which has all the information necessary for you to bring a claim yourself - Annual members £60, otherwise £95 including VAT
Members of our online service will find information on the site about the two types of proceedings, the difference between them, and when it is appropriate to use them. Or if you prefer you can instruct us to advise on which type is best for you.
If your claim for possession does not fall into one of these two categories you will need to instruct us to advise before any claim can be brought. We will assess your case and give you a quotation for our fees (if your case is one we can deal with). Normally this will be similar to our fixed fees.
Note that our fixed fees do not apply if your case becomes defended. If you think this is likley you need to instruct us to advise before taking any action. STAGE THREE - ENFORCEMENT
If your tenants fail to vacate after the possession order has been made against them, you will need to instruct the court bailiffs to physically evict them. OUR CHARGE (exising clients only) - £152.50 (£50 plus VAT and the court fee)
These services and special prices are only available to Landlord-Law Online annual members.
