Student Lettings - tenancy agreements designed specifically for landlords of student properties

In many respects lettings to students are very similar to lettings to other types of tenant. However there are two particular legal problems with tenancy agreements for students:

  1. The tenancy agreement is almost invariably signed by the incoming tenants several months before they are due to move in, at a time when the previous tenants are still resident. This then creates a potential problem for the landlord if the outgoing tenants fail to vacate.
  2. Most tenants will not want to live at the property during the summer vacation. How can these months be dealt with?

NB - if you let to students but do not have a problem with these two issues, then you should use the normal AST agreements, either Type A or Type B.

The first problem is dealt with by explaining the problem in the tenancy agreement document, and setting out what will happen if the tenants stay on after they have told you they are leaving, and you have signed up with new tenants. The object is to limit your liability, and to make the outgoing tenants liable to compensate you for any expenses you are put to if they do not leave.

Note that all the agreements provide for rent to be calculated on a monthly basis, and to be paid as specifically set out in the agreement (which has a space for you to do this). So, to give a couple of examples, you could provide for it to be paid every calendar month on the 1st day of the month, or by three payments to be paid by specific dates (eg the commencement dates of each term).
