Common Law Tenancy agreements

Not all tenancies are assured shorthold tenancies. There are three important exceptions. The tenancies for these are in this section:
- Company lets - where the tenant is a limited company (our agreement is for use where the property will be occupied by a director or employee of the company)
- Resident landlord lets - where the landlord lives in self contained accommodation in the same buidling (so long as it is not a purpose built block of flats), and
- High rent lets - where the rent is over £25,000 per annum (lets with rent under £250 pa or £1,000 pa in Greater London also fall under the common law, but there will not be many of these!)

Note that the high rent limit for ASTs will be rising from £25,000 to £100,000 on 1 October 2010. At that time all tenancy agreements with a rent of between £25,000 and £100,00 will convert automatically to ASTs. You will need to protect any deposit taken at that time Please follow >> my blog for updates on recommended procedures to deal with the change when these are known.
