The tenancy Agreements
There are four basic types of tenancy agreement:
- Type A. Those where the tenant or tenants occupy the whole of a house or flat, and if there is more than one tenant, they all sign the same tenancy agreement
- Type B. Those where individual tenants in a flat or house each have a separate tenancy agreement for their own room(s) and share the rest of the property with the other tenants
- Type C. Those where the tenancy is not an assured shorthold tenancy but is regulated under the common law, because either it is let to a company (a company let), the landlord lives in the same building (a resident landlord let) or the rent is over £25,000 per year (a high rent let).
- Student Lets. These are our special tenancy agreements for landlords of student properties. These are variants of the Type A agreements. There is also an out of season holiday let agreement here, which can be used for non students.
We also now have
a section with agreements for letting agents using the Tenancy Deposit Scheme (TDS) provided by the Dispute Service.
All of the tenancy types have a basic format. Then apart from the student let agreements, most agreements are available in versions for weekly and monthly rent payments, plus there are a number of variants, as follows:
- Guarantor - includes a guarantee clause
- Break clause - where the tenancy can be ended early (for use with tenancies with a longer term)
- Variable rent clause - where the landlord can specify a different method of payment (for example for student lets where the tenants wish to pay all the rent for each term in advance)
- Bills included - where the bills (such as gas and electricity) are included with the rent
- Pets - these are our special tenancy agreements developed for use where you permit your tenant to keep a pet. You can read more about these here
You will find (apart from in the student let section) additional agreements with these elements in various combinations in the various sub sections linked from this page. If you are an annual member and the particular combination you require is not online, send an email and a new version will be prepared and loaded up, generally within 48 hours.
Renewal forms
If you just want to renew a fixed term and/or increase the rent, you can use our short renewal form rather than get the tenant to sign up to a complete new agreement. There is a suitable renewal form for each of tenancy types A, B and C, which you will find in the relevant sub sections.
Lodger agreements
If you share accommodation with a lodger, this is not a tenancy and your lodger not will be entitled to many of the statutory rights that tenants have. These agreements are therefore a little different from the tenancy agreements.
